UNEP/CHW.4/3 CONSOLIDATED LISTS OF WASTES AND THE APPLICABLE PROCEDURE FOR THEIR REVIEW OR ADJUSTMENT

I. Reference

1. Decision III/1 (Amendment to the Basel Convention) and decision III/12 (Hazard characterization) of the third meeting of the Conference of the Parties.

II. Background

2. At its seventh session, held in March 1995, the Technical Working Group reviewed the issue of hazard characterization of wastes and identified the development of lists of wastes and the applicable procedure for their review as a possible way of approaching this subject.

3. At its eighth session, held in June 1995, the Technical Working Group undertook an extensive review of the work done so far on lists and confirmed the need to draw up a list of wastes that are clearly hazardous and a list of wastes that are not likely to be subject to the Basel Convention.

III. Decisions of the Conference of the Parties

at its third meeting

4. In its decision III/1 (Amendment to the Basel Convention), the Conference of the Parties noted that the Technical Working Group had already commenced its work on the development of lists of wastes that are hazardous and wastes that are not subject to the Convention. In the same decision, the Conference instructed its Technical Working Group to give full priority to completing the work on hazard characterization and the development of lists and technical guidelines in order to submit them for approval to the Conference of the Parties at its fourth meeting.

By paragraph 3 (c) of its decision III/12 (Hazard characterization), the Conference of the Parties requested the Technical Working Group to consider ways of taking forward the development of lists of hazardous wastes and the applicable procedure for their review based on the outcome of the work of the Technical Working Group, in particular the outcome of its seventh and eighth sessions as well as further developing lists of wastes not covered by the Basel Convention. The Technical Working Group was requested by paragraph 4 of the same decision to report on the above activities to the Conference of the Parties at its fourth meeting.

IV. Lists of wastes

6. The consolidated lists of wastes as agreed by the Technical Working Group are contained in annex I to the present note. The annex consists of:

(a) The wastes placed on list A (Wastes characterized as hazardous under Article 1, paragraph 1(a), of the Basel Convention);

(b) The wastes placed on list B (Wastes which will not be covered by Article 1, paragraph 1(a) of the Basel Convention unless they contain Annex I materials to an extent causing them to exhibit an Annex III characteristic).

V. Draft review procedure

7. At its twelfth session, the Technical Working Group agreed on the format and content of the Application Form and procedure for reviewing or adjusting lists A and B of wastes. The draft Application Form for the placement or removal of wastes on list A or list B, together with the application form procedure, is set out in annex II to the present note.

VI. Proposed action

8. The Conference may wish:

(a) To consider lists A and B together with the applicable procedure for their review or adjustment;

(b) To adopt the two lists of wastes, namely list A and list B;

(c) To agree that lists A and B have to be considered together for inclusion into the framework of the Basel Convention;

(d) To further adopt the Application Form and the application form procedure for reviewing or adjusting lists A and B;

(e) To request the Secretariat of the Basel Convention, on behalf of the Technical Working Group, to keep a record of decisions taken by the Technical Working Group to place on or remove wastes from list A or list B for future reference.

LIST A WASTES CHARACTERIZED AS HAZARDOUS UNDER ARTICLE 1, PARAGRAPH 1 (a), OF THE BASEL CONVENTION

[A1010] Metal wastes and waste consisting of alloys of any of the following:

APPLICATION FORM PROCEDURE Who is to complete the Form (applicant)?

- Any Contracting Party, observer State, NGO, private company or individual has the right to fill in the Application Form with the proposed placement of wastes under list A or list B, or with a proposal for removing wastes from list A, list B or working list C.

Procedure for transmission of the Form

- The applicant must present the Application Form with any supporting annexes and attachments to national authorities for the Basel Convention.

- The Competent Authority and/or Focal Point should consider the Application Form with any supporting annexes and attachments and only forward it to the SBC if it is properly completed and if it considers the completed application provides sufficient information for the TWG to reach a decision.

- It is for the national authority to decide how the Application Form will be forwarded to the Secretariat of the Basel Convention. Normally, the Competent Authority or Focal Point of the Basel Convention will be responsible for transmitting the Form to SBC. For those Parties that have more than one Competent Authority, they will need to decide through which Competent Authority the Form should be forwarded to SBC.

- The TWG will consider the application at its next meeting provided it is received by the SBC within the timeframe outlined below.

Time-frame for application

- The Application Form for placement or removal of wastes has to be submitted to SBC at least three months prior to the meeting of the TWG. The Secretariat will despatch completed applications within two months of the date of the next TWG meeting.

- Competent Authorities and/or Focal Points are requested to make available any annexes or attachments to all Focal Points of the Basel Convention and to advise the SBC that this is done.

- If a Competent Authority and/or Focal Point is unable to make available any annexes or attachments to all Focal Points of the Basel Convention, they may request the Secretariat to undertake this function.

- In exceptional circumstances, a Party may communicate a proposal(s) for placement or removal of wastes six weeks before the meeting of the Technical Working Group if such proposal(s) cannot be sent to SBC within the three month deadline. The Party, in this case, would need to send the proposal(s) to all other Focal Points as well as to SBC. The TWG would endeavour to consider such application(s) at its next meeting.
