UNEP/CHW.4/6 AMENDMENT OF THE BASEL CONVENTION

Proposal submitted on behalf of the European Community

1. The following paragraph shall be added at the end of Annex I:

"In particular, and without prejudice to Article 1 paragraph 1 (a), the wastes characterised as hazardous are listed in Annex VIII, and wastes not so characterised are listed in Annex IX."

2. At the fourth meeting of the Conference of the Parties, two new Annexes shall be established to incorporate the lists developed by the Technical Working Group:

Annex VIII: "Wastes characterized as hazardous under Article 1, paragraph 1 (a), of the Basel Convention"

[set out the Technical Working Group's list A, changing references to "List B" to "Annex IX"]

Annex IX: "Wastes placed on this Annex will not be wastes covered by Article 1 paragraph 1 (a) of the Basel Convention unless they contain Annex I material to an extent causing them to exhibit an Annex III characteristic"

[set out the Technical Working Group's list B, changing references to "List A" to "Annex VIII"]
