UNEP/CHW.4/7 AMENDMENT OF THE BASEL CONVENTION


Proposal of Chile

1. The following paragraph shall be added at the end of Annex I: "To facilitate the implementation of the Convention, and, in particular, its Article 4, the Parties will consider as hazardous wastes, in accordance with Article 1 (1 (a)), those wastes included in Annex VIII, and will not consider as such those included in Annex IX. The Conference of the Parties shall determine a procedure for revising the lists established in Annexes VIII and IX. The wastes in Annex I (Categories of wasters to be controlled) not included in either Annex VIII or Annex IX shall be subject to the Convention, whenever they possess any of the characteristics in Annex III."

2. At the fourth meeting of the Conference of the Parties, two new Annexes shall be established to incorporate the lists developed by the Technical Working Group.

Annex VIII: "Wastes characterized as hazardous under Article 1, paragraph 1 (a), of the Convention, a characterization that does not preclude the use of Annex III to demonstrate that a waste is not hazardous".

Annex IX: "Wastes characterized as not hazardous, unless they contain Annex I material to an extent causing them to exhibit an Annex III characteristics".
