'''Manner and Means'''

6. It was part of the conspiracy that the defendant, FREDDY CAYAFFA
MONTANO, owned and operated Sarah's Trading, an e-waste demanufacturing
facility, located in Doraville, Georgia. Sarah's Trading received e-waste,
All in violation of Title 18, United States Code, Section 371.
'''IV. PLEA AGREEMENT'''
::'''10.''' The Defendant, his counsel, and the Government, subject to approval by the Court, have agreed upon a negotiated plea in this case, the terms of which are as follows:

''No Additional Charges''
::'''11.''' The United States Attorney for the Northern District of Georgia agrees not to bring further criminal charges against the Defendant related to the charges to which he is pleading guilty. Judicial Economy
::'''22.''' Based on the factors set forth in 18 U.S.C. § 3553(a), the parties agree to recommend that the Defendant receive a one-level downward variance at sentencing. This variance is predicated on the Defendant's expeditiously entered plea of guilty and the resulting conservation of limited judicial and prosecutorial resources.

''Specific Sentence Recommendation''
::'''23.''' The Government agrees to recommend that the Defendant be sentenced at the low end of the adjusted guideline range.
Diversified Recycling did XYZ.
Lots of evidence beyond what was listed in Evidentiary Report.
Shifting material between facilities prior to audits.
Sending material to Sarah's Trading for long period of time... just to clean out warehouses.
Sarah's is very obviously bad downstream place.
According to discussions with owner, they supposedly also took material from IMS Recycling, Goodwill, and ____. But BAN was unable to follow up with those connections.

==Summary==
Intercon Solutions, an electronics recycler based in Illinois, was found in 2011 by BAN investigators to be engaged in exporting electronic waste to Hong Kong right while they were seeking to become e-Stewards Certified. BAN notified the Hong Kong authorities and they confirmed the container photographed at Intercon’s facility and tracked to Asia was indeed contraband. Such exportation is a critical non-conformity of the e-Stewards Standard. After BAN made the news public and denied Intercon access to the e-Steward Certification program, the company sued BAN for defamation. After a lengthy legal battle, on October 9 of 2015, Intercon's case was dismissed with prejudice, and BAN was able to publicly release evidence received in large part from whistleblowers and collected in preparation for the expected court trial. The new evidence reveals that Intercon was a massive exporter of electronic waste. Such exportation was likely a violation of international, Chinese and US law.
==Summary==
==Summary==

==Summary==
==Summary==
Intercon Solutions, an electronics recycler based in Illinois, was found in 2011 by BAN investigators to be engaging in numerous fraudulent and illegal activities. When results of these investigations were made public, Intercon vigorously denied them and launched a defamation lawsuit against BAN. After a lengthy legal battle, in October of 2015 Intercon's case was dismissed with prejudice, and BAN was able to publicly release their collected evidence.
==Summary==
Intercon Solutions, an electronics recycler based in Illinois, was found by BAN to be engaging in numerous fraudulent and illegal activities during various investigations. When results of these investigations were made public, Intercon vigorously denied and launched a defamation lawsuit against BAN. After a lengthy legal battle, Intercon's case was dismissed with prejudice in October of 2015 and BAN was able to publicly release their collected evidence.
